Practice

Edward’s practice is predominantly litigation and covers a broad range in the Chancery and commercial fields.

He is involved in cases concerning the construction of commercial contracts and guarantees, directors’ duties, company and shareholder issues, insolvency.

A significant proportion of his work includes fraud, constructive trusts and the tracing of assets and the appropriate measure of damages/compensation under the Companies Act and in negligence and fraudulent misrepresentation.

In recent years he has appeared in cases in Hong Kong and the Cayman Islands.

Edward also undertakes commercial drafting and advisory work in the company/insolvency and banking spheres and has settled banking documentation for one of the clearing banks, advised on a disposal of underwriting business at Lloyds and drafted two complex multi-company schemes of arrangement recently sanctioned in the Hong Kong companies court.

Notable recent cases

  • Barings v Coopers & Lybrand & Ors [2003] PNLR 34 on behalf of Deliotte & Touche (Singapore) in that firm’s contribution claim against Coopers & Lybrand (London) (11.06.03) (unreported) and
  • Kuwait Airways Corporation in its damages claim for the conversion of certain of its aircraft after the 1990 invasion of Kuwait, (November 2003).
  • He also represented Lloyds in enforcement proceedings arising out of R&R/Equitas.
